This Subscription Payment Plan Agreement (“Agreement”) outlines the terms and conditions governing the subscription payment plans offered by HAACH (“Company”) to its customers (“Subscriber”). By enrolling in a subscription payment plan with HAACH, you agree to the following terms and conditions:
1. General Terms
1.1. This Agreement applies to all subscription plans offered by HAACH, including, but not limited to, facial treatment, wellness programs and related products.
1.2. By subscribing to any plan, the Subscriber agrees to pay the subscription fees as outlined in their chosen plan and to abide by all terms set forth in this Agreement.
2. Payment Terms
2.1. The subscription fee will be billed monthly, quarterly, or annually, as per the Subscriber’s chosen plan, using the payment method provided at the time of subscription.
2.2. Payments are due on the date specified in the subscription plan, and the Subscriber authorises HAACH to automatically charge the provided payment method for each billing cycle until the subscription is cancelled.
2.3. If a payment is declined due to insufficient funds or any other reason, the Subscriber agrees to resolve the issue promptly. HAACH reserves the right to suspend services until the payment is successfully processed.
3. Subscription Plan Duration
3.1. Subscription plans have a commitment period starting from the date of the first payment, after which the subscription will continue on a month-to-month basis unless otherwise specified.
3.2. Subscribers may upgrade their plan during the minimum commitment period, subject to HAACH’s approval and any applicable adjustments to subscription fees.
4. Cancellation and Refund Policy
4.1. Subscription plans are strictly non-refundable and non-exchangeable for any non-usage by the Subscriber. No refunds or credits will be provided for unused sessions, missed appointments, or lack of engagement with the services offered under the subscription plan.
4.2. No refunds will be provided for any payments already processed, except where required by law. Any outstanding payments due up to the effective date of cancellation must be paid in full.
4.3. In the event that the Subscriber fails to attend or utilise the services provided under the subscription plan, no refunds or credits will be provided.
5. Changes to Subscription Plans
5.1. HAACH reserves the right to modify subscription plans, including but not limited to pricing, terms, and services, with at least 30 days prior notice to Subscribers.
5.2. Subscribers may opt out of the modified plan by providing written notice before the changes take effect. Continued use of services after the change date will constitute acceptance of the new terms.
6. Subscriber Obligations
6.1. The Subscriber agrees to maintain accurate and up-to-date billing information throughout the term of the subscription.
6.2. The Subscriber is responsible for ensuring that their payment method is active and capable of processing the subscription fees. Failure to do so may result in service suspension or cancellation.
6.3. The Subscriber agrees to comply with all instructions and policies related to the services provided under their subscription plan.
7. Service Availability
7.1. HAACH will make reasonable efforts to ensure service availability. However, HAACH is not responsible for any delays, interruptions, or unavailability of services due to unforeseen circumstances beyond its control.
7.2. HAACH reserves the right to temporarily suspend services for maintenance, upgrades, or other necessary actions, with prior notice provided to Subscribers whenever possible.
8. Limitation of Liability
8.1. HAACH shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the services, even if HAACH has been advised of the possibility of such damages.
9. Governing Law
9.1. This Agreement shall be governed by and construed in accordance with the laws of Singapore. Any disputes arising from or relating to this Agreement shall be resolved through binding arbitration in Singapore.
10. Amendments
10.1. HAACH reserves the right to amend the terms of this Agreement with prior notice to Subscribers. Subscribers will be given 30 days to review any amendments before they take effect.
10.2. Continued use of services after the amendments become effective will constitute acceptance of the new terms.
